Welcome to AudioLaunch. These Terms of Service ("Terms") govern your use of the AudioLaunch mobile application ("the App") operated by AudioLaunch ("we", "our", or "us") from the Netherlands. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
AudioLaunch is currently in early access (beta). This means:
By using the App during early access, you acknowledge these risks and agree that AudioLaunch is not liable for data loss or service interruptions related to the beta nature of the product. We strongly encourage you to back up important recordings outside the App.
You must be at least 13 years old (or 16 in the EEA) to use AudioLaunch. By creating an account, you represent that you meet this age requirement. You are responsible for:
You may not create multiple accounts, impersonate others, or use the App for any unlawful purpose.
You retain full ownership of all audio recordings, compositions, and other content you create using the App ("Your Content"). We claim no ownership rights over Your Content.
By publishing Your Content to the AudioLaunch community library, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, stream, and distribute Your Content within the App for the purpose of community features. This license ends when you delete Your Content or your account.
You agree not to upload, publish, or share content that:
You may delete Your Content at any time. We may also remove content that violates these Terms without prior notice. Repeated violations may result in account suspension or termination.
We reserve the right to review, moderate, and remove any user-generated content that violates these Terms or that we determine, in our sole discretion, to be harmful or inappropriate. Moderation may include automated filtering and human review.
If you believe content on the App infringes your intellectual property rights, please contact us at legal@audio-launch.com with:
Your public profile (display name, avatar, badges, level, and published content) is visible to other users. You are responsible for the information you share publicly. Do not share personal contact information, financial details, or other sensitive data in community spaces. We are not responsible for third-party actions based on information you publicly share.
The App offers an optional paid subscription ("AudioLaunch Pro") with additional features including high-quality recording, unlimited recordings, pro-only effects, and exclusive cosmetics. Subscription details, pricing, and billing periods are displayed at the time of purchase.
All purchases are processed through the Google Play Store or Apple App Store. Payment terms are governed by the respective platform's terms. We do not directly handle your payment information.
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. Refunds are handled by the respective app store according to their refund policy. EU consumers have the right to withdraw from a digital purchase within 14 days, unless you have consented to immediate performance and acknowledged loss of the right of withdrawal.
In-app items (fuel, badges, cosmetics, artifacts) are virtual goods with no monetary value. They cannot be exchanged, transferred, sold, or redeemed for real currency. Virtual items may be modified or removed as part of game balancing during early access.
The App, including its design, code, graphics, sounds, the Resonara world-building, game mechanics, and all associated intellectual property, is owned by AudioLaunch and protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, reverse-engineer, decompile, or create derivative works from the App.
The App incorporates open-source software components, each governed by their respective licenses. A list of open-source dependencies and their licenses is available in the App under Settings → Credits → Open Source Licenses.
You agree to use the App in a lawful and respectful manner. You may not:
We may suspend or terminate your account if you violate these Terms, with or without prior notice depending on severity. Upon termination:
You may also delete your account at any time through the App's Settings or by contacting us.
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
During the early access period, additional limitations apply as described in Section 1.
To the maximum extent permitted by applicable law, AudioLaunch and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, recordings, profits, or goodwill, arising out of or in connection with your use of the App.
Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or EUR 50, whichever is greater.
Note: Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability that cannot be excluded under applicable law.
You agree to indemnify and hold harmless AudioLaunch from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.
Informal Resolution First: Before initiating any formal legal proceedings, you agree to first contact us at legal@audio-launch.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any dispute within 30 days.
Governing Law: These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
Jurisdiction: If informal resolution is unsuccessful, any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands. EU consumers may also bring proceedings in the courts of their country of residence.
EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, power outages, internet disruptions, government actions, or third-party service failures.
We may modify these Terms at any time. Material changes will be communicated through the App or via email at least 30 days before taking effect. Continued use of the App after changes take effect constitutes acceptance of the modified Terms. If you do not agree with the changes, you should stop using the App and delete your account.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AudioLaunch regarding the use of the App. They supersede any prior agreements or understandings.
